At the Water Police Court yesterday before Mr Delobory, S M , Edward T Florey and Montague E Beecroft were committed for trial on a charge of being concerned in the theft of 8s 5 1/2d from Thomas Ramsay.

Edward Forest Florey and Montague Edmund Beecroft, robbery with violence.

• Event: The Sydney Morning Herald, 1 Aug 1894. ALLEGED ROBBERY AND ASSAULT.

Edward Forest Florey and Montague Edward Beecroft were presented on a charge of assaulting Thomas Ramsay, at Svdnev, on 19th July, and rob-

bing him of 8s 3 1/2d and for having immediately after they robbed him struck and used other corporal

violence to Ramsay.

Mr Cromwell appeared for Beecroft.

The case for the Crown was that on the night of 19th July the prosecutor went to a house in Dowling-street, and when there the two accused came in. There were other men there He attempted to leave, when one of the women of the house tried to trip him, and he was thrown down outside the door, the accused holding him down while the female who tripped him took the money out of his right-hand pocket. He then got up and ran into the lane, when Beecroft struck him on the jaw with his fist. Prosecutor said he would report the matter to the police, whereupon Florey twisted his wrist.

The defence was that Beecroft took no part what ever in the assault or robberv, and Florey made a denial of the charge.

The jury found Florey guiltv of robbery, and re- turned a verdiet of not guilty against Beecroft, who was discharged.

His Honor sentenced Florey to 18 months hard labour in Darlinghurst Gaol.

• His obituary was published in The Sydney Morning Herald on 22 Aug 1938. BUYING A STEAM ORGAN.
Beecroft v The Public Trustee.

This action was brought by Linda Beecroft against the Public Trustee to recover £550, the return of a deposit and damages, for alleged breach of warranty. The declaration set out that the action was brought against the Public Trustee as the administrator of the estate and effects of one Frank Lauret, deceased. The plaintiff was the wife of a showman and proprietor of a merry-go-round which was used at Sydney shows, and ran a circuit of country fairs and carnivals thoughout the year. Mrs. Lauret, widow of the deceased, interviewed the Beecrofts, and induced them to consider a proposal to purchase an organ imported by Lauret for their business, assuring them that it was capable of playing several beautiful tunes, such as "The Blue Danube," Mrs. Beecroft decided to buy the instrument in her own name, and, after interviewing the Public Trustee, paid him £ 300 deposit, and gave a promissory note for £ 225, being the balance of the purchase money. The instrument was eventually tested under required conditions, but refused to play a note. The declaration set out that the warranty had been that the organ was in good working condition, and would play and give forth certain musical sounds, whereas it gave forth no sound at all.

The Public Trustee in his defence pleaded never indebted, and denied that he had made any promise or warranty whatever.

Mr. R. R. Kidston and Mr. Telfer (instructed by Messrs. Walter Dickson and Co.) appeared for the plaintiff; and Mr. W. F. L. Owen (instructed by Mr. F. L. Rolin) for the defendant.

The plaintiff was non-suited on the ground that the evidence disclosed no warranty as alledged in the declaration.
