• Event: Launceston Examiner, 14 Aug 1885. LARCENY AS A BAILEE.-James Joseph Mountain was charged by Mr. Superintendent Armstrong with having, on the 11th inst., tried to dispose of a horse, the property of J. J. Hatton Jordan. J. J. Hatton Jordan deposed he resided at St. Leonards; on the 11th inst. the defendant went to him and asked for a loan of a horse, with which he said he wanted to go as far as the Race course Hotel; the horse was the same one as he had seen outside the Court that morning; he valued it at about £25, and did not give the defendant any instructions to sell the horse. Frederick Augustus Edwards deposed he resided at the Criterion Hotel in this town ; he saw the defendant on Tuesday last at about 11 a.m.; the defendant asked witness and another person if either of them wanted to buy a horse; witness said he was looking about for a good horse for a friend of his, and he went out into the stable of the Criterion Hotel and had a look at the animal; it was a mare, and defen- dant said her age was not yet seven years; wit- ness did not approve of the animal ; defendant said he would take £16 for the horse; he told the groom of the stables that he had brought the horse from the Piper River. George Vernon Beecroft deposed he was a blacksmith residing in Launceston ; he saw the defendant on the 11th inst. when he was riding a horse; witness asked him where he got the horse from, and he said from a " rabbiter" at Campbell Town ; witness asked him what he wanted for it, and he said £17; he walked home and defendant followed him : witness said he did not have the time to talk to him about it just then ; defendant called again at the shop during the day, and he said he would give him the horse for witness's grey horse and £2 10s; he refused to do that, and defendant went away. (Here Mr. B. P. Farrelly vacated his seat on the Bench.) Joseph Stanley deposed he knew the defen- dant Mountain ;l he saw him in Launceston on the 11th inst; he was then trying to dispose of a horse; he wanted £16 for it ; defendant said he wanted to buy a cart horse, and that he would let him have the horse for £12 10s with the bridle, or the animal alone for £11; wit- ness refused to buy the horse. Superintendent Robert Armstrong deposed to having arrested the defendant on the 11th inst. This concluded the case, and in answer to the Bench defendant said it was just to test the value of the mare that he offered to sell her, but he had no intention whatever of selling her. The defendant was committed for trial at the next sittings of the Supreme Court. Defendant was allowed bail, himself in £100, and two others in £50 each.
