Oakley to Cartmill Deed

Whereas Christopher Oakley died possessed of one tract of land situated in Bath County on Slate Creek containing one hundred and forty acres be the same more or less and whereas John Ginter has become entitled to two equal shares of said land with the other heirs one share of said land by inter marriage with Polly Oakley, one of the legal heirs & descendants of said Christopher Oakley, deceased, and one share by purchase from Edmond Oakley, another of the legal heirs and descendants of Christopher Oakley, deceased. Now know all men by thse presents that we John Ginter and Polly Ginter, late Polly Oakley for and in consideration of one hundred and seventy dollars to us in hand paid, the receipt whereof is hereby acknowledged, have granted, bargained and sold & by these presents do grant bargain and sell a lien & convey unto David Cartmill of the County of Bath all our title to------ as interest in the aforesaid tract or parcel of land belonging to the said estate of Christopher Oakley, deceased, in which as his heirs or devices, we were entitled to as well by purchase as decreed. Hereby and in consideration of the aforesaid sum of money forever guaranteeing to said David Cartmill the peacable and quiet enjoyment by himself, his heirs and assigns forever of all and every interest which said John Ginter, Polly Ginter and Edmund S. Oakley were entitled to possess in said tract of land by virtue of said descent before mentioned or in any other way wherefore for themselves their heirs and all others claiming any interest therein, through or under the land. They do hereby forever surrender to said David Cartmill there interest in said land. In testimony whereby they have hereunto set their hands and seals this 21st day of December 1833.

I Benjamin F. Sudduth Deputy for William M. Sudduth, Clk of the County Court for the County aforesaid do certify that this deed of conveyance from John Ginter and Polly, his wife to David Cartmel was this day acknowledged before me by the said John Ginter to be his act and deed, hand and seal. She the said Polly Ginter being privately examined by me separate and apart from the said husband, declared that she did freely and willingly, signed the seal and delivered said deed without the threats or persuasions of her husband and acknowledged the said writing, again shown and explained to her to be her act and deed, hand and seal, and that she wished not to retract it, but consented that the same might be recorded whereupon the same hath been duly admitted to record in my office. Given under my hand as Deputy Clerk aforesaid this 21st day of December 1833.
